Please read these Terms and Conditions carefully before placing an order. These Terms govern purchases made through our website and form part of the contract between you and THE-ESCAPADES LTD.

Our Shipping & Delivery Policy, Returns & Refunds Policy and Privacy Policy also apply. The more specific policy will apply to the subject it covers, but nothing in these Terms or those policies limits rights that cannot legally be excluded.

By placing an order, you confirm that you have read and agree to these Terms.

Our registered office is not a customer returns address. Products must only be returned to the address or carrier specified in our return instructions.

2. Application of These Terms

These Terms apply to consumer purchases made through our website at theescapades.co.uk and any checkout operated by us.

By placing an order, you confirm that:

  • You are at least 18 years old;

  • You are legally capable of entering into a binding contract;

  • The information you provide is complete and accurate; and

  • You are purchasing primarily for personal use and not for resale.

If you are purchasing wholly or mainly for business purposes, please contact us before ordering. Certain consumer protections referred to in these Terms may not apply to business purchases.

You should save or print a copy of these Terms and the order confirmation for future reference.

3. Definitions

In these Terms:

  • Consumer means an individual acting wholly or mainly outside their trade, business, craft or profession;

  • Contract means the contract between you and us for the sale of Goods;

  • Goods means the products identified in an Order accepted by us;

  • Order means your offer to purchase Goods from us;

  • Website means the website and checkout operated by THE-ESCAPADES LTD; and

  • Working day means Monday to Friday, excluding applicable public holidays.

4. Product Information

We take reasonable care to ensure that product descriptions, specifications, prices and images are accurate.

However:

  • Product images are illustrative and packaging may vary;

  • Colours may appear differently depending on the device or display used;

  • Measurements, weights and dimensions may be approximate;

  • Fit and sizing guidance is indicative and does not guarantee a particular fit; and

  • Products remain subject to availability.

Where a manufacturer changes packaging, minor specifications or non-material product details, we may supply the updated version provided it is not materially different from the product ordered.

We may make changes required to comply with law, safety requirements or manufacturer instructions, provided those changes do not materially reduce the product’s quality or intended function.

5. Climbing and Safety-Critical Equipment

Some Goods are safety-critical or form part of a personal protective or life-safety system. These may include:

  • Climbing ropes;

  • Harnesses;

  • Helmets;

  • Slings and quickdraws;

  • Carabiners;

  • Cams, nuts and other protection equipment;

  • Belay and abseil devices;

  • Via ferrata equipment;

  • Load-bearing textile products; and

  • Other climbing or personal protective equipment.

You are responsible for selecting equipment that is suitable for your intended activity, ability, environment and existing equipment system.

Before use, you must:

  • Read and follow all manufacturer instructions, warnings and limitations;

  • Check compatibility with other equipment;

  • Inspect the product for damage, deterioration, contamination or missing parts;

  • Obtain appropriate training and competent instruction where required; and

  • Ensure that the product is used, stored, maintained and retired in accordance with the manufacturer’s guidance.

Climbing and mountaineering involve an inherent risk of serious injury or death. Product information and customer-service guidance are not substitutes for appropriate training, experience, supervision or professional instruction.

You must stop using safety-critical equipment immediately if it may have been damaged, overloaded, involved in a fall, contaminated, modified or otherwise compromised.

Nothing in this section excludes our responsibility for defective Goods, inaccurate product descriptions, negligence or any other liability that cannot legally be excluded.

6. Orders and Contract Formation

The checkout process allows you to review and correct your Order before submitting it.

When you place an Order, you are making an offer to purchase the Goods. An automated order acknowledgement or payment authorisation confirms receipt of the Order but does not necessarily mean that we have accepted it.

A Contract for each product is formed when we:

  • Send a dispatch confirmation for that product; or

  • Otherwise expressly confirm that we have accepted the Order.

Where products are dispatched separately, a separate Contract may be formed for each dispatched product.

We may decline or cancel an Order before acceptance where, for example:

  • A product is unavailable;

  • Payment cannot be authorised;

  • There is an obvious pricing or description error;

  • We reasonably suspect fraud, misuse or unauthorised payment;

  • Delivery is unavailable or restricted for the address or product;

  • A product is subject to a legal, safety, manufacturer or carrier restriction; or

  • We cannot fulfil the Order for another legitimate operational reason.

If we cancel an Order after payment has been taken, we will refund the affected amount to the original payment method without undue delay.

7. Prices, Taxes and Payment

Prices are shown in pounds sterling unless another currency is expressly displayed.

Prices include VAT where applicable. Delivery charges and any other payable charges will be shown before you complete the Order.

For international orders, local import VAT, GST, customs duties, brokerage charges or handling fees may be payable unless checkout expressly states that they are included. Further details are set out in our Shipping & Delivery Policy.

Payment is taken or authorised at checkout using the payment methods displayed. You confirm that you are authorised to use the selected payment method.

Pricing errors

We try to ensure prices are correct. If a price is obviously incorrect and could reasonably have been recognised as an error, we may decline or cancel the affected Order before dispatch. If payment has already been taken, we will issue a full refund for the affected product.

Discounts and promotions

Discount codes and promotions:

  • Apply subject to their stated conditions;

  • Must be entered before the Order is completed;

  • May be restricted by product, customer, date or minimum spend;

  • May not be combined unless expressly permitted; and

  • Have no cash value unless the promotion states otherwise.

We may withdraw or amend a promotion prospectively, but this will not change a discount already validly applied to an accepted Order.

8. Delivery

Delivery options, prices, destinations, product-specific charges and estimated timeframes are set out in our Shipping & Delivery Policy and at checkout.

Delivery estimates normally begin on dispatch rather than on the date of Order. Processing time may be additional.

Unless a different period has been agreed, we will deliver Goods without undue delay and no later than 30 days after the Contract is formed.

You are responsible for providing a complete and accurate delivery address and any access information reasonably required by the carrier.

We may use Royal Mail, UPS, DPD, FedEx, a fulfilment partner or another suitable carrier. Products in the same Order may be dispatched separately, from different fulfilment locations or under different shipping profiles.

Our use of a third-party carrier does not remove our legal responsibility for delivery. If a material delay occurs, we will take reasonable steps to inform you and resolve it. Your statutory rights in relation to late or failed delivery remain unaffected.

Where you expressly nominate a safe place, neighbour, collection point or alternative recipient, delivery may be treated as completed when the parcel is delivered there in accordance with your instruction.

9. Risk and Ownership

Goods remain at our risk until they come into the physical possession of:

  • You; or

  • A person you have identified to take possession of them on your behalf.

An exception may apply where you independently appoint a carrier that we did not offer as a delivery option.

Ownership of the Goods passes to you when we have received payment in full and the Goods have been delivered.

10. Cancelling an Order Before Dispatch

You may ask us to cancel an Order before dispatch by contacting orders@theescapades.co.uk as soon as possible.

We will make reasonable efforts to stop the Order, but Orders may enter processing quickly and cancellation before dispatch cannot be guaranteed.

If an Order has already been dispatched, you may exercise any applicable cancellation or return right under these Terms and our Returns & Refunds Policy.

11. Statutory Cancellation Rights for Online Orders

If you are a Consumer purchasing online, you normally have the right to cancel an eligible Contract without giving a reason.

To exercise the statutory cancellation right:

  • You must clearly tell us that you wish to cancel within 14 calendar days after the Goods are delivered; and

  • After notifying us, you must return or send the Goods back within a further 14 calendar days.

You may cancel using the return link in your order confirmation, by emailing orders@theescapades.co.uk, or by using the model cancellation form at the end of these Terms.

A clear cancellation statement is sufficient. You do not have to use the model form or provide a reason.

Your statutory cancellation rights operate independently of our voluntary 30-day return and exchange policy.

12. Our Voluntary 30-Day Return Policy

In addition to statutory rights, we accept eligible change-of-mind returns within 30 calendar days of delivery.

To use the voluntary policy, you must notify us and send or hand the product to the return carrier no later than 30 calendar days after delivery.

The voluntary period extending beyond statutory cancellation rights is subject to all conditions in our Returns & Refunds Policy. During days 15 to 30, we may decline a return or exchange where the product is no longer new, unused, complete and suitable for resale.

The voluntary policy does not reduce or replace any more favourable statutory right.

13. Condition of Change-of-Mind Returns

Products returned because you have changed your mind should be:

  • Unused and unworn, other than reasonable inspection or trying on;

  • Unwashed, unaltered and unmodified;

  • Clean and free from dirt, chalk, hair, odours, stains, damage and signs of use;

  • Complete with all components, accessories, instructions and supplied parts;

  • Accompanied by original tags, labels, seals and retail packaging where supplied; and

  • Packaged securely for return transit.

During the statutory cancellation period, you may handle and inspect Goods only to the extent reasonably necessary to establish their nature, characteristics, fit and basic functioning, in a similar way to an inspection in a shop.

Where handling exceeds what is reasonably necessary and reduces the product’s value, we may make a proportionate deduction reflecting the actual diminished value.

For voluntary returns and exchanges outside the statutory cancellation period, we may refuse the request if the applicable return conditions are not met.

Climbing shoes

Climbing shoes may be tried on indoors on a clean, non-abrasive surface solely to assess fit. They must not be used on a climbing wall, training board, climbing hold, gym floor, outdoor surface or other abrasive surface.

Safety-critical equipment

Under our voluntary return and exchange policy, safety-critical equipment will normally be accepted only where its condition, history and integrity can be verified. It must be unused, unloaded, unmodified and complete with all safety, traceability and manufacturer information.

Ropes must remain sealed and must not have been uncoiled, tied, loaded, climbed with or dragged across a surface. Harnesses may be tried on over clean clothing solely to assess fit but must not be weighted, hung in or used for climbing.

Safety-critical equipment is not treated as a blanket exception to statutory cancellation rights. Statutory requests will be handled in accordance with applicable law, including the rules on reasonable inspection and diminished value.

14. Return Shipping Charges

For an eligible non-faulty change-of-mind return, you are responsible for the direct cost of returning the Goods.

Where our standard prepaid return label is available:

  • The label costs £3.95 per eligible return parcel;

  • The £3.95 return-postage cost will be deducted from your refund; and

  • The charge is for return transport, not a handling, administration or restocking fee.

You may instead arrange and pay for your own tracked and appropriately insured return service. If you do so, we will not deduct the £3.95 prepaid-label charge.

The £3.95 service may not be available for bulky, heavy, oversized, restricted, Channel Islands or international returns, including certain ropes, hangboards, large bags and crash or bouldering pads. We will confirm the available return method and cost where a different service is required.

For Goods which cannot normally be returned by post, we will provide an applicable or estimated return cost before purchase where required by law.

We do not charge a standard handling, administration or restocking fee.

If Goods are faulty, damaged, unsafe, incorrect, misdescribed or otherwise do not conform to the Contract, we will arrange the return or bear reasonable standard return costs where required by law, provided you use or obtain approval for the return method.

15. Exchanges

We offer a voluntary exchange service for eligible products where you require a different size or colour of the same product, subject to availability.

The original product must be returned within the applicable return period and must meet all relevant conditions in these Terms and our Returns & Refunds Policy.

For an eligible non-faulty change-of-mind exchange, a £4.95 standard exchange shipping charge applies. It covers:

  • One standard prepaid label for returning the original product; and

  • Standard delivery of one replacement product.

The £4.95 charge is an exchange shipping charge and not a handling or restocking fee. It applies to the standard exchange service as a whole. Arranging and paying for your own return does not automatically remove the £4.95 charge because the charge also covers dispatch of the replacement, unless we expressly agree otherwise.

After the original product has been received, inspected and approved, we will dispatch the replacement as soon as reasonably possible.

Replacement stock is not guaranteed until the exchange is processed. Where possible, we may temporarily reserve the requested size or colour, but availability cannot be guaranteed.

If the requested replacement is unavailable, we will contact you and offer another available size or colour of the same product or a refund in accordance with our Returns & Refunds Policy.

If the replacement has a different price, any additional amount must be paid before dispatch and any applicable lower-price difference will be refunded.

If you require a different product rather than another size or colour of the same product, you must return the original product for a refund and place a new Order.

Bulky, oversized, restricted and international exchanges may require a different service or charge, which will be confirmed before the return is arranged.

The £4.95 change-of-mind exchange charge does not apply where Goods are faulty, damaged, unsafe, incorrect or misdescribed and we provide or approve the return and replacement method.

Our voluntary exchange service does not limit your statutory right to cancel an eligible online Order and request a refund.

16. Refunds

Approved refunds will be made to the original payment method unless you expressly agree otherwise.

For a statutory cancellation, we will reimburse sums due without undue delay and no later than 14 days after:

  • We receive the returned Goods; or

  • You provide acceptable evidence that the Goods have been sent back,

whichever occurs first.

We may withhold reimbursement until we receive the Goods or acceptable evidence of return, unless we arranged to collect them.

Where statutory cancellation applies, we will refund the cost of our least expensive standard outbound delivery service where required. If you chose an enhanced, express, premium or time-guaranteed service, the additional amount above standard delivery need not be refunded.

For returns relying solely on our voluntary policy during days 15 to 30, we will process an approved refund no later than 14 days after receiving and inspecting the returned product.

A prepaid return-label charge, agreed exchange charge or lawful diminished-value deduction may be deducted where applicable.

Your bank, card issuer or payment provider may take additional time to credit the refund after we issue it.

17. Products Excluded from Change-of-Mind Cancellation

Where permitted by law, change-of-mind cancellation rights do not apply to certain products, which may include:

  • Goods made to your specifications or clearly personalised;

  • Goods liable to deteriorate or expire rapidly;

  • Sealed Goods not suitable for return for genuine health-protection or hygiene reasons once unsealed;

  • Sealed audio, video or computer software once unsealed;

  • Newspapers, periodicals or magazines, other than subscription contracts;

  • Digital content supplied immediately after you expressly consented to supply beginning and acknowledged the loss of the cancellation right; and

  • Any other category specifically excluded by applicable law.

Where relevant, an exclusion will be identified before purchase.

Safety-critical equipment is not automatically excluded merely because it is safety-critical or because ordinary packaging has been opened.

These exclusions do not affect rights relating to Goods that are faulty, unsafe, damaged, incorrect, misdescribed or otherwise not in conformity with the Contract.

18. Faulty, Damaged, Unsafe or Incorrect Goods

Goods must be of satisfactory quality, fit for their intended purpose and as described.

If Goods are faulty, unsafe, damaged, incorrect, not as described or otherwise do not conform to the Contract, contact orders@theescapades.co.uk as soon as reasonably possible.

Depending on the timing and circumstances, you may be entitled to:

  • A short-term right to reject;

  • Repair or replacement;

  • A price reduction; or

  • A final right to reject and receive a refund.

Where you are legally entitled to repair or replacement, we will provide the remedy within a reasonable time and without significant inconvenience, and we will bear necessary costs including reasonable standard postage.

Where you validly reject non-conforming Goods, we will bear reasonable return costs and provide the remedy required by law.

If you suspect a safety fault, stop using the product immediately. We may ask for photographs, batch details, serial information or a description of the issue to help us assess it, but this will not be used to unreasonably delay or deny a legal remedy.

Manufacturer warranties and commercial guarantees are additional to and do not replace statutory rights.

19. Inspection of Returned Goods

We may inspect returned Goods to confirm:

  • Their identity and condition;

  • Whether all components are present;

  • Whether they show signs of use, loading, damage, contamination or alteration;

  • Whether safety labels, serial numbers and traceability information remain intact; and

  • Whether the applicable return or exchange conditions have been met.

Where a statutory cancellation return has been handled beyond what is reasonably necessary, any deduction will reflect actual diminished value and will not be an arbitrary restocking fee.

Where a voluntary return or exchange is refused, the Goods remain yours. You may be required to pay the reasonable cost of sending them back to you.

20. Website Accounts and Security

If you create an account, you are responsible for keeping your login details confidential and for activity carried out through the account, except where caused by our breach of duty.

You must provide accurate information and notify us promptly if you believe an account or payment method has been used without authority.

We may suspend or restrict an account where reasonably necessary to protect customers, prevent fraud, comply with law or protect the Website.

21. Website Use and Intellectual Property

The Website and its content, including text, branding, graphics, photographs, layout and software, are owned by or licensed to THE-ESCAPADES LTD and are protected by intellectual-property laws.

You may use the Website for personal, lawful shopping and information purposes. You must not, without permission:

  • Copy or commercially exploit Website content;

  • Interfere with the Website’s security or operation;

  • Introduce malware or harmful code;

  • Attempt unauthorised access to systems or accounts;

  • Use automated tools in a way that materially disrupts the Website; or

  • Use the Website for unlawful, fraudulent or abusive activity.

22. Third-Party Services and Links

We may use third parties for payment processing, delivery, fulfilment, reviews, analytics or other services.

Third-party links may be provided for convenience. We are not responsible for the content or practices of independent third-party websites, although this does not affect our responsibility for subcontractors we use to perform our Contract with you.

23. Our Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:

  • Death or personal injury caused by negligence;

  • Fraud or fraudulent misrepresentation;

  • Defective products where liability cannot legally be excluded;

  • Breach of statutory rights relating to Goods; or

  • Any other matter for which liability cannot legally be excluded or restricted.

If we breach the Contract, we are responsible for loss or damage that is a foreseeable result of that breach or our failure to use reasonable care and skill.

We are not responsible for loss or damage that is not foreseeable, not caused by our breach, or caused by your misuse of a product, failure to follow manufacturer instructions, incompatible equipment selection, unauthorised modification or continued use after damage or a safety warning, to the extent that those matters caused the loss.

These Terms are intended for Consumer purchases. We are not responsible for business losses such as loss of profit, revenue, contracts, business opportunity, goodwill or business interruption arising from Goods purchased primarily for personal use.

24. Events Outside Our Reasonable Control

We are not responsible for delay or failure caused by an event outside our reasonable control, such as severe weather, transport disruption, industrial action, natural disaster, epidemic, cyber incident, carrier network failure, customs delay, government action or interruption to utilities.

We will take reasonable steps to minimise the effect, notify you where appropriate and resume performance when reasonably possible.

This section does not remove rights you may have where delivery is materially delayed or cannot be completed.

25. Privacy and Electronic Communications

We process personal data in accordance with our Privacy Policy and applicable data-protection law.

Order-related communications, including confirmations, dispatch notices, safety information, recalls and service messages, are necessary communications relating to the Contract.

Marketing communications are handled separately and may be opted out of in accordance with our Privacy Policy.

26. Complaints

If you have a complaint, contact info@theescapades.co.uk and include your Order number where relevant.

We aim to:

  • Acknowledge complaints within 2 working days; and

  • Resolve straightforward complaints within 5 working days.

More complex complaints, carrier investigations, manufacturer assessments or safety matters may take longer. We will keep you reasonably informed.

If we cannot resolve a consumer complaint, we will provide information about any applicable alternative dispute-resolution body where we are legally required to do so. We are not obliged to participate in a particular scheme unless the law or a binding scheme requires it.

27. Changes to These Terms

We may amend these Terms from time to time for future Orders, including to reflect changes in law, business processes, delivery services or policies.

The version in force when you place an Order will apply to that Order. We will not retrospectively change an accepted Contract without your agreement unless a change is required by law.

28. General Provisions

Severability

If a court or competent authority finds part of these Terms unlawful or unenforceable, the remaining provisions will continue to apply.

Waiver

If we do not immediately enforce a right, this does not mean that we have waived it.

Transfer

We may transfer our rights and obligations under a Contract to another organisation where this does not reduce your rights. You may transfer your rights where the law permits or with our written agreement.

Third-party rights

Unless these Terms expressly state otherwise, no person other than you and us has a right to enforce the Contract.

Entire agreement

These Terms, the accepted Order and the policies incorporated into them form the agreement between you and us for the purchase of the Goods. This does not exclude liability for fraud or prevent reliance on mandatory consumer rights or binding pre-contract information.

29. Governing Law and Courts

These Terms and Contracts are governed by the law of England and Wales.

If you live in England or Wales, proceedings may be brought in the courts of England and Wales.

If you live in Scotland, you may bring proceedings in Scotland or England and Wales.

If you live in Northern Ireland, you may bring proceedings in Northern Ireland or England and Wales.

If you live outside the United Kingdom, mandatory consumer protections and jurisdiction rights in your country of residence may also apply.
